1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Ozone Archive website, community features, and related tools and software (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy.

2. Eligibility

You must be legally able to enter into a binding agreement in your jurisdiction to use the Services. If you are under the age required by your local law to use online services, you may only use the Services with permission and supervision of a parent or legal guardian.

3. Accounts & Security

3.1 Account Creation

Some features require an account. You agree to provide accurate information and keep it updated. You are responsible for all activity on your account.

3.2 Security

• Keep your login credentials confidential and do not share them.
• Notify us promptly if you believe your account has been compromised.
• Do not attempt to access accounts or data that are not yours.

4. Community Conduct Guidelines

Ozone Archive is a professional, music-focused community. You agree to use the Services respectfully and lawfully.

4.1 Prohibited Conduct

• Copyright violations: posting, sharing, or distributing content you do not have rights to use.
• Harassment or hate: abusive, hateful, discriminatory, or threatening content or behavior.
• Sexual or exploitative content: especially content involving minors (strictly prohibited).
• Illegal activity: including scams, fraud, or instructions facilitating wrongdoing.
• Impersonation: pretending to be someone else, including artists, staff, or other users.
• Spam: unsolicited promotions, mass messaging, or deceptive engagement tactics.
• Security abuse: probing, scanning, or attempting to bypass security; introducing malware.

4.2 Professional Communication

Keep discussions constructive. Critique music respectfully. Do not share private information about others without permission.

5. User Content & Permissions

5.1 Your Content

"User Content" means content you submit or make available through the Services (including profile information, posts, comments, links, and embedded media references). You retain ownership of your User Content.

5.2 Your Responsibility

You represent and warrant that you own or have all necessary rights, licenses, and permissions to post your User Content, including rights to any music, artwork, and trademarks.

5.3 License to Operate the Service

You grant Ozone Archive a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content solely as needed to operate, maintain, and improve the Services.

5.4 Removal

We may remove or restrict access to User Content that violates these Terms or applicable law, or that we reasonably believe may harm the community or the Services.

6. Copyright & Takedowns

We respect intellectual property rights. Do not upload or share infringing content.

6.1 Reporting Copyright Concerns

If you believe content on Ozone Archive infringes your copyright, contact us at [email protected] with the subject line "Copyright Takedown" and include:

• Identification of the copyrighted work claimed to be infringed.
• Identification of the infringing material and where it is located on the Services.
• Your contact information.
• A statement that you have a good-faith belief the use is not authorized.
• A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act.
• Your physical or electronic signature.

7. ARC Tools & Software Terms

Ozone Archive may provide access to audio tools (such as ARC Mix Assistant, ARC Loudness Analyzer, ARC Mastering Engine) and may offer installers or local services to enable certain functionality.

7.1 Local Processing & Your System

• Some ARC tools run in your browser; some may run locally on your computer (e.g., via localhost).
• You are responsible for your device, backups, and system configuration.
• Do not use the tools to process or distribute audio you do not have the rights to use.

7.2 Beta/Experimental Features

Some tools or features may be experimental. They may change, break, or be removed at any time.

7.3 No Professional Guarantee

Mixing and mastering suggestions are informational and creative guidance. You are responsible for reviewing and deciding what to apply.

8. Third-Party Services

The Services may integrate with or link to third-party services (for example: SoundCloud embeds, hosting, authentication, analytics, or AI model providers). Third-party services are governed by their own terms and privacy policies.

9. Enforcement, Moderation & Termination

We may investigate violations and take action, including warnings, removal of content, feature restrictions, suspensions, or termination of accounts.

10. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, OZONE ARCHIVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OZONE ARCHIVE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES.

12. Indemnification

You agree to defend, indemnify, and hold harmless Ozone Archive from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Services, your User Content, or your violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. We will update the "Last Updated" date at the top of this page. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
